H1B Quota Still OPEN as of April 23rd 2009 USCIS

According to the USCIS, as of April 20, 2009 there are still a substantial number of slots open under the fiscal year 2010 H1B "regular cap" quota. The CIS reports that the "advanced degree exception" of 20,000 H1B numbers has been exhausted. They further report that as of the end of last week, they had received 44,000 new H1B petitions that have been counted against the 65,000 "regular cap." How long the quota will remain open is anyone's guess. The USCIS figures are less than reassuring as to their accuracy. On April 9th, that agency initially reported that petitions equal to "almost half" the regular cap of 65,000 had been filed during the first five business days that petitions were accepted. Two business days later (April 13th), they reported that they had received 43,000 petitions in total. Taken at face value, that would have meant that they received at least another 11,000 petitions during those two business days. Five business days

PERM PROCESS RESUMES

In What if a federal agency shut down and no one noticed? Strange as it seems, that is exactly what happened with the Department of Labor for almost nine months. The DOL had an issue with a contract for workers to staff their Atlanta PERM processing center and as a result, had virtually no staff for almost nine months. The curious thing is that no one really noticed that the lights were out. What does that say about DOL efficiency? They shut down for most of a year and no one really noticed because they are so slow anyway. With their contractor problem resolved, at least for the present, they have resumed processing PERM cases. As of March 31, 2009, the DOL reported the following processing backlogs: Final reviews:  cases filed in August, 2008 Audits:  audit files submitted in September, 2007 Appeals: appeals filed in June 2007 The DOL's new iCert Portal is now scheduled to go on-line September 1, 2009 - assuming there are no further delays. We do not yet have any idea as to how,

ORACLE ACQUIRES SUN MICROSYSTEM

Oracle's clearly a big shopoholic. Over the past few years, it swallowed People-Soft, Siebel Systems, JD Edwards, India's i-flex and BEA Systems. And now Larry Ellison is all set to cut a cheque of $7.4 billion to pocket Sun Microsystems Clearly, Ellison is trying to make his company Oracle a global software superpower. And embarking on "binge shopping'' is one of the ways to hit that ultimate goal, say analysts. For Oracle, one way to grab the market of its arch rival Microsoft in core segments like operating systems and browsers is by getting into powerful operating systems. Acquiring or developing such products can be extremely expensive and time consuming. Competing with Microsoft's well entrenched infrastructure products will also be a tough proposition. A few years ago Oracle had got into selling massive integrated packages, rather than selling products in bits and pieces, through acquiring the banking technology solutions provider i-flex solutions.

H1 B Application Is less than 40% as compare to Last year

For the first time in several years, the US is yet to receive enough petitions for H-1B work visas, much sought after by highly skilled professionals, even a week after opening the counter for applicants. The US Citizenship and Immigration Services (USCIS) announced today that it will continue to accept H-1B non-immigrant visa petitions till it receives enough applications to reach the Congress-mandated cap of 65,000 in the regular category and another 20,000 for those holding a master's or higher educational degree from a US university. Immigration experts believe this is the immediate fallout of the current economic crisis, resulting in thousands of job losses in the last one year, and the prevailing anti-H-1B atmosphere in the US. USCIS officials did not, however, comment on how many H-1B visa petitions for highly skilled professionals the agency received during the first five working days after it started receiving the petitions from April 1 for the fiscal beginning Oct
